Access Mandarin

Terms and Conditions

 

 

 

1)         The term “Access Mandarin” hereby refers to the entity owned by Kevin M. Kelly and any person or institution employed by Kevin M. Kelly.  The term “Student (s)” hereby refers to any person participating in, travelling on, or having applied for an Access Mandarin programme.

2)                  Students and anyone claiming through a Student agree that as a condition of participating in and travelling on any Access Mandarin programme they shall have no rights, directly or indirectly, under and in theory at law or in equity against Access Mandarin or any person or institution employed or in cooperation with Access Mandarin.

3)                  Access Mandarin cannot be held responsible for any injury, loss, disability, or mental or physical problem suffered by the Student during participation in any aspect of Access Mandarin programmes, while travelling unsupervised and when travelling with or attending excursions supervised by Access Mandarin.

4)                  In the event of political or international unrest, acts of God, war, natural disasters, personal emergencies or accidents, or in the case of any other situation under which Access Mandarin deems appropriate, Access Mandarin reserves the right and has full authority to take whatever actions it deems necessary, and all Students (and anyone claiming through a Student) fully release Access Mandarin from any liability from such actions or any decisions that may be made or taken as a result of such a situation.

5)                  In the event that Access Mandarin deems necessary and appropriate, Access Mandarin may, without Student consent or consent of any parent, guardian, or third party, place a Student or visiting family member or friend at such person’s own expense or his or her parent’s or legal guardian’s expense without such person’s consent in a hospital or other medical institution for medical treatment or other services, or if no such hospital or institution is readily available, Access Mandarin may place the student in the hands of and under the discretion of a local medical doctor for treatment.

6)                  Access Mandarin reserves the right to terminate Student participation in or relation and contact with any Access Mandarin programme or affiliate without any refund under circumstances of misconduct or in any circumstance or situation in which Access Mandarin deems it appropriate.

7)                  Methods and amounts of payment for Access Mandarin service fees as outlined in the website, http://www.accessmandarin.com, shall be adhered to and honoured by the Student or his or her parent or legal guardian.

8)                  Any price, amount, or deadline as quoted or defined on the Access Mandarin website, http://www.accessmandarin.com,  is understood to be an estimate or is understood to be subject to change and Access Mandarin cannot be held responsible or liable for inaccuracies due to such change or estimates.

9)                  Under circumstances of refusal of payment of Access Mandarin fees or inability to pay for Access Mandarin fees for whatever reason, Access Mandarin reserves the right to terminate all contact with the Student, both in China or internationally, and to pursue legal action against said Student.

10)              It is understood that any fee other than Access Mandarin’s service fee as required of the Student by third parties and any institution in relation with Access Mandarin but not a direct employee of Access Mandarin shall bear no relation to Access Mandarin and Access Mandarin cannot be held responsible for such fees.  Access Mandarin cannot be held liable or responsible for any problem or legal action taken as a result of said third party fees, fee amounts, or lack of payment of such fees.

11)              It is understood that refund of the Access Mandarin service fee or deposit will not be given under any circumstances unless deemed appropriate by Access Mandarin.

12)              If a Student should borrow any monies from Access Mandarin for emergency treatment, evacuation, or any other reason, he or she (or the parents or legal guardian of said Student) shall be responsible for timely repayment of such monies in full.  Access Mandarin reserves the right to take legal action to obtain any such borrowed monies in the event of untimely payment or refusal of payment.

13)              Access Mandarin will not be held responsible or liable for the refusal or denial of a Student’s visa, passport, or any other documents required for entry into China or entry into China itself, or participation in any Access Mandarin programme, or the refusal of acceptance by university, institution, or Access Mandarin to any Access Mandarin programme for any reason.

14)              Access Mandarin reserves the right to use any pictures of Students or comments made by Students for printed, oral, and internet publicity materials without consent and cannot be held liable for such use.
